Welcome to the 3 tier logic website. 3 tier logic provides a software-as-a-service (SaaS) consumer engagement, rewards and data-mining platform. As a provider of these consumer management and data-mining solutions, the 3 tier logic Team is committed to protecting the privacy of those individuals who visit our website and individuals whose personal data we may receive through the use of our PLATFORM³ Consumer Management Portal and other related services provided to our customers.

This privacy statement describes our practices regarding the personal information we collect on and through our websites which link to this privacy statement.  This privacy statement also describes – under the heading, Customer Data – our role and practices in connection with personal information we may host on behalf of our SaaS customers.

As a visitor to this website, your privacy remains under your control.  We want you to have the information you need to make your own decisions regarding your privacy in the context of your interaction with 3 tier logic websites.

1. Websites Covered

This Privacy Statement covers the information practices of 3 tier logic websites sites that link to this Privacy Statement, including mobile devices and http://www.3tierlogic.com; http://panel.platform3.co/; www.3tltechcorp.com and 3kudos.com (collectively "websites") or any other templated microsite portals hosted by 3 tier logic ("Microsites") . These websites and Microsites are hosted in the U.S. and Canada.  Collectively the websites and the Microsites are known as the Sites.

Our Sites may contain links to non-3 tier logic websites. We are not responsible for the information practices or the content of such other websites. We invite you to review the privacy statements of those other websites to understand their information practices.

2. Consent

By providing personal information to use via our Sites, you consent to its use in accordance with this Privacy Statement and, if you live outside the U.S. or Canada, you consent to the transfer of such information to the U.S. and Canada.

3. Personal Information We Collect

3.1  Information You Give Us: We receive and store any information you enter on our Sites or give us in any other way. This information may include (a) your name, email address, and other personal information such as gender, date of birth and/or mailing address; (b) your interaction with Sites features; (c) transaction-related information; (d) information you provide us when you contact us for assistance; and (e) products or services you have purchased.

Any data that has been collected in which all personal identifiers have been removed, such that the information could not reasonably be used to identify the individual, is not considered Personal Information.  In this Privacy Policy information that specifically identifies you as an individual specifically referenced as being collected in this section 3.1 and any other information also collected about you due to the nature of using the Internet and browsing websites is referred to as "Personal Information").

3.1.1 Registering for Account
When you register for an account on so you can use a Microsite (an “Account”), we may collect and store the Personal Information that you provide us to provide you with access to the Microsite. 

3.1.2 Use of the Sites
When you enter information on, or use, the Sites, we may collect, store and use this information, some of which may be or contain Personal Information to allow you to use the the Sites.


3.1.3 Contacting Us
When you choose to contact 3 tier logic, we may collect, store and use the Personal Information that you provide to us, such as your name, email address and other information you choose to provide in the content of your message, so we can respond to your inquiry.  We will retain all related correspondence from us to you and all related records. We retain these records in order to measure and improve our customer service, or as required to comply with applicable law and/or regulation

3.1.4 Other Purposes
Additionally, 3 tier logic may collect, store, and use Personal Information to solicit your feedback or to help improve the Sites, advise you about new products, notify you about changes to the Sites, provide you with our newsletter or advertising and marketing material and communicate with you for other commonly accepted purposes. You may opt-out of newsletters and other promotional emails that you receive from us at any time.

3.1.5 Surveys

We may offer optional questionnaires and surveys to you for the purposes of assessing our Sites's quality.

Such survey information and results, once completely stripped of Personal Information, may be combined with other data for purposes of quality assurance and additionally the use of the information collected will be explained in detail in the survey itself.  No Personal Information will be collected in the course of conducting the survey but if we collect personally identifiable information from you, our users in these questionnaires and surveys, the users will be given notice of how the information will be used prior to their participation in the survey or questionnaire.  

If you give us permission, we may contact you for a follow-up in connection with survey results.

3.2 Non-Personal information
We may also collect, use and disclose non-Personal Information that does not directly identify you as follows:

 
3.2.1 Aggregated Data
3 tier logic may collect, use and disclose de-personalized information generated from the Sites for the purposes of statistical and demographic research, analysis, reporting and to further develop the Sites and ancillary services. “Aggregated Data” means data 3 tier logic collects about your use of the Sites, that has been aggregated and de-personalized.  All Aggregated Data is and will be, as between us and you, the property of 3 tier logic and not considered to be Personal Information.


3.2.2 Cookies
When you access or use the Sites, we may use “cookies” to track what you view and interact with on the Sites. 3 tier logic treats information collected by cookies and similar technologies as non-personal information. A “cookie” is a small bit of record-keeping information that is sent to your computer. The cookies that 3 tier logic uses do not include personal information and may be used to: (1) help you navigate around the Sites, (2) monitor how many people are using the Sites, and (3) track trends. Once you leave the Sites, the cookie is not retained on your computer. Most browsers are initially set up to accept cookies, but you can disable cookies or set your browser to indicate when a cookie is being sent. However, disabling cookies may affect your ability to access the Sites.

Typically cookies establish anonymous browsing record until a visitor fills out a form (at 3tierlogic.com) or creates an Account for the Sites at which point we match the visitor’s anonymous record to an identifiable visitor using the information provided by filling out the form or creating an Account.  At that point this cookie contains Personal Information that we use in accordance with this privacy policy.

3.2.3 User Generated Comments
You should be aware of the open nature of certain features of the Sites that we may make available to you such as user-generated content such as comments. quotes and interactions you have with other members via communities or forums (“Submissions”). You may choose to disclose information in the course of a Submission, but this must not include any of your Personal Information.  3 tier logic may publicly post your Submission within the Sites after it has been de-personalized and stripped of any of your stored Personal Information.  Any Personal Information which you disclose in the body of the Submission, in contravention of this clause, may be posted with the rest of your Submission.

2.2.4 Server Logs
3 tier logic’ servers may log non-personal information about your use of the Sites, such as: (1) your search activity, pages viewed, the date and time of activity; and (2) any information provided by your computer or mobile device in connection with your use of the Sites, such as your browser type, browser language, IP address, mobile carrier, unique device identifier, location, and requested and referring URLs.

2.2.5 Trusted Partners and Sponsored Companies and Organizations
We may use and disclose to our affiliated companies, contractors, trusted partners or persons collected non-Personal Information for the purpose of reporting aggregated information, auditing, researching and analyzing usage of the Sites, ensuring the technical functionality of the Sites and further developing the Sites and other 3 tier logic products.

2.2.6 Site Traffic Information

Due to the technical nature of web-browsing, when you visit our Sites, we obtain the following information:

  1. the web address of the Site that you came from or are going to;

  2. which pages features of our Sites you visit or use;

  3. the type of browser you use;

  4. the times you access our Sites;

  5. the type of device you use to access our Sites;

  6. the content of any undeleted cookies that your browser previously accepted from us or delivered to your device via use of our Sites;

  7. technical information, including the address used to connect your device to the Internet, your login information, system and operating system type and version, browser or app version, time zone setting, operating system and platform, and your location (based on IP address);

  8. information about your visit, including products and services you viewed or used, response times, interaction information (such as button presses) and any phone number used to call our customer service number;

  9. other typical web browsing information automatically which is stored in log files including for example, Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data

We may use standard Internet technology, such as web beacons and other similar technologies, to track your use of our Sites. We may allow third-parties, including our authorized service providers, to access usage information regarding how you use our Sites.   We use all this collected information only to try to understand your preferences better and to manage the load on our servers, so as to improve our service, analyze trends, optimize performance, administer and improve Site performance, and gather broad demographic information for aggregate use.   We do not track the websites that you visit before or after you leave our Sites.

4. Use of Personal Information Collected

We may use your information (a) to deliver our Site services and features desired by you (including any customization features requested by you), (b) to improve our services for you, (c) to personalize content and offers that may be of interest to you, (d) to respond to your inquiries, and (e) to fulfill your request for products or services. If provided, we may use your email address to contact you from time to time.

Cookies allow us to store and retrieve login information on a user’s system. They provide us with data that we can use to improve the quality of our Site and make it easier to use.

We use information gathered automatically and stored in log files to analyze trends, to administer a Site, to track user's movements around the Site and to gather demographic information about our user base as a whole. For example, we may use the non-personally identifiable information, like your IP address, to statistically analyze Site usage and to customize our Site’s content, layout and services. The resulting information will allow us to improve our services and better understand and serve our Site users.

5. Sharing of Personal Information Collected

5.1  We share information that identifies you only as described below and with subsidiaries we control that follow the same practices described in this Privacy Statement.

a) Third Party Service Providers: We may retain other companies and individuals to perform functions on our behalf, such as sending email, removing repetitive and inaccurate information from customer lists, analyzing data, processing credit cards, and providing marketing assistance. They have access to personal information needed to perform their functions, but may not use it for other purposes.

b)Protecting Others and Ourselves: We will disclose your personally identifiable information if we believe disclosure is necessary to comply with the law or to protect our rights, property, or safety, our customer, or others. In particular, we may cooperate with law enforcement agencies in any official investigation and disclose your personally identifiable information to the relevant agency in doing so.

c) Business Transfer: We reserve the right to transfer your personal information in the event 3 tier logic, Inc. or substantially all of our assets are acquired.

d) With Your Consent: Other than as stated above, we will not disclose or provide your personal information to a third party without your explicit consent for us to do so.

5.2 Need-to-know disclosure

Only those who “need to know” have access to Personal Information. This includes relevant quality control personnel, 3 tier logic developers, and technical support. All Personal Information is stored indefinitely on an encrypted server.  All data is backed up daily and a copy is stored securely off-site.

Based on our legitimate interest in managing and planning our business, we may analyse data about your use of our products and services to, for example, troubleshoot bugs within the Sites, forecast demand of service and to understand other trends in use, including which features users use the most and find most helpful, and what features users require from us. This does not involve making any decisions about you - it is only about improving our Sites so that we can deliver better services to you. Strict confidentiality and data security provisions will apply at all times.

We limit access to all Personal information about you to those employees and agents who need to know the information to provide products and services to you.

3 tier logic will not disclose your Personal Information to anyone other than to our employees and those third parties that require such information in order to provide us those services that help administer our business. We will require that these parties agree to process such Personal Information based on our instructions and in compliance with this Privacy Policy, any applicable law, and any other appropriate confidentiality and security measures.

5.3 Other disclosure

We will not disclose any of your Personal Information (and in particular PHI) to third parties except in the limited circumstances described below, or with your express permission. These third parties are limited by law or by contract from using the information for secondary purposes beyond the purposes for which the information is disclosed.  We disclose information appropriate to the circumstances as determined in our sole unfettered discretion.

a) We disclose information in response to a subpoena, warrant, court order, levy, attachment, order of a court-appointed receiver or other comparable legal process whether criminal or civil, including subpoenas from private parties in a civil action.

b) If we merge or are acquired by another company then the successor company would have access to your information but would continue to be bound by this Privacy Policy.

c) We may use a third party communication company to communicate with you. We will require such third party to only use your contact information for the purpose of our communications with you and will also require such third party to delete such contact information from their records following the termination of their retainer by 3 tier logic

d) We may share your Personal Information with our authorized service providers that perform certain services on our behalf. These services may include hosting, performing business and sales analysis, supporting our Sites functionality, and supporting features offered through our Sites. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes.

e) We disclose information that we are required by applicable law to disclose to applicable parties including, without limitation, law enforcement authorities, regulators or auditors.

6. Choices and Communication Preferences

As a visitor to our Sites you can always choose not to provide us with personal information when requested, although it may be required for you to take full advantage of our Site offerings. If your browser is not already set up to refuse cookies, you can configure your browser to refuse them. By doing so you may not be able to take full advantage of our Site features.

You may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of our marketing emails.

If 3 tier logic proposes to collect, use or disclose Personal Information for any purpose other than those described in this Privacy Policy, we will obtain your consent or offer you an effective way to opt out of the use of personal information for those other purposes. You may choose to withdraw your consent to the collection, use or disclosure of your personal information as outlined in this Privacy Policy at any time. If you withdraw consent, then 3 tier logic may no longer be able to provide you with full or any access to the Programs. Users are also given the opportunity to “opt-out” of having their Personal Information used for specific purposes such as receiving newsletters or other information from 3 tier logic. Withdrawals of consent will not have an effect on personal or other data that 3 tier logic has used or disclosed in accordance with this Privacy Policy prior to such withdrawals.

7. Security

3 tier logic uses a secure infrastructure, industry standard technology, and appropriate technical and operational safeguards designed to protect the security, confidentiality, and integrity of data submitted to 3 tier logic. The security of your personal information also depends on your protection of your account. Please do not disclose your Site login credentials to unauthorized people. Also, be sure to sign off when finished using a shared computer. If you have any other questions about the security of our Sites, please contact us.

The security of your 3 tier logic Account also relies on your protection of your password. You may not share your password with anyone. 3 tier logic will never ask you to send your password or other sensitive information to us in an email, though we may ask you to enter this type of information on the 3 tier logic websites, at the following URLs: www.3tierlogic.com  or any of our other Sites. 

Any email or other communication requesting your password, asking you to provide sensitive account information via email, or linking to a Site with a URL other than those specified within this document should be treated as unauthorized and suspicious and should be reported to 3 tier logic immediately. If you do share your 3 tier logic password with a third party for any reason, you may be responsible for actions taken using your password. If you believe someone else has obtained access to your password, please contact us right away.

8. Customer Data

Following the deletion of personal information in a database we host, the related backup data will be deleted, generally within 30 days.

Anonymous Statistics: To assist our customers and partners and to market our services, we may disclose anonymous, aggregated, statistical information related to the use of our services by many or all of our customers. Such information will not contain any personal information or identify any customer or user of our services.

Data storage:  Unless otherwise permitted by applicable law, your personal information will be stored and maintained on servers and databases located in Canada or the United States and is subject to regulation under the laws of Canada and the United States.

We retain all records related to messages sent or received via 3 tier logic, your personal identification or any other information about you or pertaining to you for as long as you fill out a form at 3 tier logic. When you obtain an Account at 3 tier logic Member, we also retain records and information about you throughout the application process. 

Once we terminate your Account, subject to applicable laws requiring us to retain records, 3 tier logic will delete any information you have provided to 3 tier logic, including, without limitation, any confidential information or personal information of yours.   Depending on legal or regulatory requirements (which may require us to retain records for an indefinite period) we may retain Personal Information you provided to us. 

You can see what information is deleted and what we continue to store after the Account is disabled by request to privacy@3tierlogic.com.

9. Children

We do not sell our services to children and children are not eligible to use our Sites. If we learn that somehow personal information from a child under 13 has been collected on or through our Sites, we will delete the information.

10. Correcting And Updating Your Information

You have the ability to review and update your personal information on our Sites by logging into your Account. You can also review and update your Personal Information by contacting us. More information about how to contact us is provided below.   You can not update your Personal Information on our Microsites.   To do so you have to contact us.

You can disable your Account by request. We can disable it at our discretion.  You can permanently disable and/or delete your Account at any time by sending an email to privacy@3tierlogic.com.We can terminate or suspend your Account at any time at our discretion.  

These terms remain in effect after your Account is disabled.

You can export a copy of content in your 3 tier logic Account if you want to back it up or use it with a service outside of 3 tier logic.  Contact customer support at: privacy@3tierlogic.com for assistance in this. You can review the Personal Information you provided us and make changes to some information, or to the settings for your Account, at any time by logging in to your Account and changing your Personal Information.

If 3 tier logic is satisfied on reasonable grounds that your request to update or correct your information should be implemented, we will correct your Personal Information on our primary system as soon as reasonably possible and send the corrected Personal Information to each organization that we have disclosed your personal information to in the past twelve (12) months. We may retain an archived copy of your records as required or authorized by applicable law.

From time to time we may update this Privacy Statement. If we do, we will update the “effective date” at the top of the Privacy Statement. If we make an update with changes that are materially less restrictive regarding our use and disclosure of your information, we will provide prior notice of such changes by posting notice on our Site at the top of the then current Privacy Statement 30 days before the effective date of the update. You should visit this page periodically to review any such changes to the Privacy Statement. Your continued use of this Site or our service and/or continued provision of information to us will be subject to the terms of the then-current Privacy Statement.
